1. Acceptance of Terms
By downloading, installing, or using the Invalesco HOMEtrack App, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, do not use the App.   

2. Description of Service
The Invalesco HOMEtrack App is a mobile application that allows homebuyers to track the progress of their new home construction. The App provides updates on construction milestones, photos and videos of the building process, inspection reports, and communication logs.

3. User Accounts

• Account Creation: To use the App, you may need to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.   
• Accurate Information: You agree to provide accurate and complete information when creating your account and to keep your information updated.
• Account Security: You are responsible for all activities that occur under your account. Notify Invalesco immediately of any unauthorized use of your account.

4. User Content

• Limited License: You grant Invalesco a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, and display any content you submit to the App (e.g., comments, feedback).   
• Content Ownership: You retain ownership of any content you submit to the App.
• Prohibited Content: You agree not to submit any content that is unlawful, harmful, defamatory, obscene, or infringing on the rights of others.

5. App Usage

• Prohibited Activities: You agree not to use the App for any illegal or unauthorized purpose. You may not: 
  • Violate any applicable laws or regulations.
  • Interfere with or disrupt the App or servers.
  • Attempt to gain unauthorized access to the App or other users' accounts.
  • Use the App to transmit any viruses or malicious code.

6. Intellectual Property
The App and its content, including but not limited to text, graphics, logos, images, and software, are the property of Invalesco Group and are protected by copyright and other intellectual property laws.

7. Disclaimer of Warranties
The App is provided "as is" without any warranties of any kind, express or implied. Invalesco disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.   

8. Limitation of Liability   
Invalesco shall not be liable for any damages of any kind arising from the use of the App, including but not limited to direct, indirect, incidental, consequential, or punitive damages.   

9. Indemnification
You agree to indemnify and hold harmless Invalesco from any and all claims, liabilities, damages, losses, costs, and expenses (including attorney's fees) arising from your use of the App or your breach of these Terms.   

10. Termination
Invalesco may terminate your access to the App at any time for any reason, with or without notice.

11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of [State where Invalesco is located], without regard to its conflict of laws principles.

12. Changes to Terms
Invalesco may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms within the App and/or sending you an email notification. Your continued use of the App after the changes become effective constitutes your acceptance of the revised Terms.
